New Policies and Regulations

ACG-RC Service Animals in Schools

On July 24, 2013 the superintendent approved Regulation ACG-RC, Service Animals in Schools. This new regulation has been developed to respond to recent federal and state actions with respect to the Americans with Disabilities Act. Regulation ACG-RA provides guidance for meeting the needs of students, employees, and other individuals with service animals within the education setting.


CNA-RB Advertising

On October 7, 2013 the superintendent approved Regulation CNA-RB, Advertising. This new regulation has been developed to provide guidance to schools and offices about advertising and the recognition of sponsors.

Revised Policies and Regulations

ACG-RB Reasonable Accommodations and Modifications for Students Eligible Under Section 504 of the Rehabilitation Act of 1973

On July 22, 2013 the superintendent approved Regulation ACG-RB, Reasonable Accommodations and Modifications for Students Eligible Under Section 504 of the Rehabilitation Act of 1973. The regulation has been renamed and updated. Procedures were updated consistent with guidance from the Office of Civil Rights. Further revisions include updating definitions to make them consistent, where appropriate, with definitions in the related MCPS regulation addressing Section 504 (Regulation ACG-RA, Reasonable Accommodations and Modifications for Individuals with Disabilities with Regard to Employment, Services, Programs, and Activities.)


ACG-RC Service Animals in Schools

On May 16, 2014, the superintendent approved Regulation ACG-RC, Service Animals in Schools. This regulation has been updated to include a new section concerning service animals in training.


BLB Rules of Procedure in Appeals and Hearings

On June 30, 2014, the Board amended Policy BLB, Rules of Procedure in Appeals and Hearings. The policy was updated in order to comply with the new Maryland State Department of Education’s regulations regarding student discipline, which must be implemented by the beginning of the 2014–2015 school year.


BLC Procedures for Review and Resolution of Special Education Disputes

On November 12, 2013, the Board adopted Policy BLC, Procedures for Review and Resolution of Special Education Disputes. This policy establishes and recognizes review and resolution options that permit cooperative problem solving of disputes regarding the identification, evaluation, educational placement, or provision of a free and appropriate public education for a student with a disability or suspected of having a disability under the Individual with Disabilities Education Act (IDEA). The revisions were made to clarify that a child must be provided with a free and appropriate education; to specify staff members to participate in administrative review committees; and to inform the Board of Education when the system appeals adverse decisions.


CFB-RA Public Charter Schools

On December 2, 2013 the superintendent approved Regulation CFB-RA, Public Charter Schools. The regulation has been revised to update directory information and update the date and office of applicant submission.


CND-RA School-Related Fund-Raising

On December 20, 2013 the superintendent approved Regulation CND-RA, School-Related Fund-Raising. The regulation has been revised to address coordination among school leadership and parent and community groups.


COB-RA Reporting a Serious Incident

On October 18, 2013 the superintendent approved Regulation COB-RA, Reporting a Serious Incident. The regulation has been updated to reflect changes in directory information and current practice.


COF-RA Alcohol, Tobacco, and Other Drugs on Montgomery County Public Schools Property

On December 20, 2013 the superintendent approved Regulation COF-RA, Alcohol, Tobacco, and Other Drugs on Montgomery County Public Schools Property. The regulation has been revised and retitled. Revisions align with the recently adopted Board of Education Policy IGN, Preventing Alcohol, Tobacco, and Other Drug Abuse in Montgomery County Public Schools.


DJA-RA Procurement of Equipment, Supplies, and Contractual Services

On July 1, 2013 the superintendent approved Regulation DJA-RA, Procurement of Equipment, Supplies, and Contractual Services. The regulation has been updated to reflect current procedures and to include language from Regulation EDB-RA, Instructional Materials and Equipment, which is recommended for rescission.


DLB-RA Authorized Signatures for Payroll Documents

On January 9, 2014, the superintendent approved Regulation DLB-RA, Authorized Signatures for Payroll Documents. The regulation has been revised to update directory information and reflect current practice.


EBK-RA Reporting and Caring for an Animal Bite

On March 25, 2014, the superintendent approved Regulation EBK-RA, Reporting and Caring for an Animal Bite. The regulation has been revised to update directory information and reflect current practice.


ECC-RA Loss of MCPS Property

On July 24, 2013 the superintendent approved Regulation ECC-RA, Loss of MCPS Property. This regulation has been updated to align with Regulation COB-RA, Reporting a Serious Incident, and updated to reflect current MCPS procedures and Maryland law.


ECG-RA Student Driving and Parking Facilities

On May 15, 2014, the superintendent approved Regulation ECG-RA, Student Driving and Parking Facilities. This regulation has been updated to include a new section concerning communication of parking policies to parents and students.


ECJ-RA Animals on School Grounds

On January 14, 2014, the superintendent approved Regulation ECJ-RA, Animals on School Grounds. The regulation has been revised to update directory information and reflect current practice regarding service animals.


ECJ-RB Animals in the Classroom

On January 14, 2014, the superintendent approved Regulation ECJ-RB, Animals in the Classroom. The regulation has been revised to update directory information and reflect current practice regarding service animals.


EGI-RA Release of Information on Students and Employees

On December 20, 2013 the superintendent approved Regulation EGI-RA, Release of Information on Students and Employees. The regulation has been revised to reflect current practices with respect to directory information about employees on school and office web pages. Language about student directory information has been revised to reference Regulation JOA-RA, Student Records, which establishes responsibilities for collecting, maintaining, and releasing information about students that is contained in student records.


EIA Self-Insurance

On May 13, 2014, the Board adopted Policy EIA, Self-Insurance. This policy has been updated to align with current practice, reflect provisions of new laws, and update directory information.


FAA Long-range Educational Facilities Planning

On June 17, 2014, the Board adopted Policy FAA, Long-range Educational Facilities Planning. Language has been added to reflect circumstances in which staff conducts roundtables or other processes to receive community input on topics broader than those related to a specific school or site; to clarify that the Board may identify alternatives to the superintendent of school’s recommendations with respect to school boundaries or geographic student choice assignment plans; and to indicate that the superintendent of schools may present a different and/or condensed process and schedule for making recommendations to the Board regarding the Capital Improvements Program, facility planning activities and school boundaries, and geographic student choice assignment plans in the event the Board determines that unusual circumstances exist.


GEC Appointment of Supporting Services Personnel

On May 13, 2014, the Board adopted Policy GEC, Appointment of Supporting Services Personnel. This policy has been updated to align with current practice, reflect provisions of new laws, and update directory information.


GHA-RA Maintenance of the Position Classification Plan

On October 18, 2013 the superintendent approved Regulation GHA-RA, Maintenance of the Position Classification Plan. The regulation has been revised to include new definitions, changes to the reclassification of positions, and changes to reconstituting a position.


IGO-RA Guidelines for Incidents of Alcohol, Tobacco, and Other Drug Abuse Involving Students

On December 19, 2013 the superintendent approved Regulation IGO-RA, Guidelines for Incidents of Alcohol, Tobacco, and Other Drug Abuse Involving Students. The regulation has been revised and retitled. Revisions align with the recently adopted Board of Education Policy IGN, Preventing Alcohol, Tobacco, and Other Drug Abuse in Montgomery County Public Schools.


IKC-RA Grade Point Averages (GPA) and Weighted Grade Point Averages (WGPA)

On August 22, 2013 the superintendent approved Regulation IKC-RA, Grade Point Averages (GPA) and Weighted Grade Point Averages (WGPA). Revisions to the regulation establish procedures for a student to retake a high school course for a replacement grade, without the lower grade being factored into the student’s GPA.


ISB-RA High School Graduation Requirements

On July 1, 2013 the superintendent approved Regulation ISB-RA, High School Graduation Requirements. This regulation has been revised to clarify dual enrollment, update the student service learning hours requirement, clarify the requirement to pass a High School Assessment in government with respect to recent changes in state regulation, provide guidance about awarding high school credit for courses taken in middle school, and to provide additional guidance on approving courses offered by institutions other than MCPS.


JEA-RA Student Attendance

On February 4, 2014, the superintendent approved Regulation JEA-RA, Student Attendance. The regulation has been revised to align with attendance procedures that have been implemented due to previous inequities in the implementation and monitoring of the loss of credit procedures.


JED-RA Residency and Tuition

On July 15, 2013 the superintendent approved Regulation JED-RA, Residency and Tuition. The regulation has been revised to update directory information and change the practice of tuition payment from the option of quarterly or monthly to yearly or semester payment. New language requires MCPS employees to either use payroll deductions for payments throughout the school year or pay full annual tuition prior to the beginning of the school year.


JFA Student Rights and Responsibilities

On June 30, 2014, the Board amended Policy JFA, Student Rights and Responsibilities. Technical changes were made to the policy to comply with the spirit of the state regulations by removing references to “zero tolerance” items, as well as to update the responsible office.


JNA-RB Collection of Student Financial Obligations

On July 24, 2013 the superintendent approved Regulation JNA-RB, Collection of Student Financial Obligations. This regulation has been updated to reflect current procedures and to include language from Regulation EDB-RA, Instructional Materials and Equipment, which is recommended for rescission.


JOA-RA Student Records

On September 10, 2013 the superintendent approved Regulation JOA-RA, Student Records. Revisions to the regulation respond to guidance from the Maryland State Department of Education. These updates accompany revisions to Regulation KLA-RA, Responding to Inquiries and Complaints from the Public, which align the process for amending student records with a hearing process designated in the Code of Maryland Regulations.


KLA-RA Responding to Inquiries and Complaints from the Public

On October 7, 2013 the superintendent approved Regulation KLA-RA, Responding to Inquiries and Complaints from the Public. Revisions to the regulation respond to guidance from the Maryland State Department of Education. These revisions accompany revisions to Regulation JOA-RA, Student Records, which align the process for amending student records with a hearing process designated in the Code of Maryland Regulations.

Rescinded Policies and Regulations

ABA-RA Community Participation in Decision-Making at the Local School

On January 7, 2014, the superintendent approved the rescission of Regulation ABA-RA, Community Participation in Decision-Making at the Local School. Policies ABA, Community Involvement and ABC, Parent and Family Involvement, reflect current priorities and practices. In addition, guidelines for stakeholder involvement in school improvement teams are extensively detailed in Baldrige-guided school improvement planning documents published on the Montgomery County Public Schools website.


EDB-RA Instructional Materials and Equipment

On July 24, 2013, the superintendent approved the rescission of Regulation EDB-RA, Instructional Materials and Equipment. Relevant language has been retained and relocated in Regulation JNA-RB, Collection of Student Debts and ObligationsRegulation DJA-RA, Procurement of Equipment, Supplies, and Contractual ServicesRegulation EDC-RA, Control of Furniture and Equipment Inventory; and Regulation DNA-RA, Disposition of Board of Education Property.
