2009-2010 School Year

New Policies and Regulations

ECK-RA Use of Lathrop E. Smith Environmental Education Center for Non-Montgomery County Public Schools (MCPS) Groups

On March 16, 2010, the superintendent approved new Regulation ECK-RAUse of Lathrop E. Smith Environmental Education Center for Non-Montgomery County Public Schools (MCPS) Groups. The associated Policy ECK, Use of Smith Center for Non-MCPS Groups was substantially revised and the redacted language moved to this new regulation.


GIH 

On October 26, 2009, the Board adopted the revision of Policy GIHFunding Other Postemployment Benefits. This is a new policy which sets forth the priorities of Montgomery County Public Schools (MCPS) Other Postemployment Benefits (OPEB) with regard to postemployment health benefits for eligible employees and retirees. The policy states that the MCPS OPEB Trust will maintain a plan of postemployment health benefits for eligible employees and retirees that is adequately funded and will ensure eligible employee access to medical coverage during their retirement years. The policy sets forth the Board's commitment to maintaining a plan of retirement/pension benefits.


GIJ Operating Fund Investments

On April 15, 2010, the Board adopted the new Policy GIJOperating Fund Investments. This policy establishes the investment scope, objectives, and guidelines for the investment of school district operating funds.


JHF Bullying, Harassment, or Intimidation

On March 9, 2010, the Board adopted new Policy JHFBullying, Harassment, or Intimidation. The policy sets forth the Board's commitment to maintaining a school environment free from bullying, harassment, or intimidation so that schools are a safe place in which to learn. The policy also directs the Montgomery County Public Schools to implement a systemwide prevention and intervention program.


JHF-RA Bullying, Harassment, or Intimidation

On June 4, 2010, the superintendent approved Regulation JHF-RABullying, Harassment, or Intimidation. This new regulation was created to accompany new Board Policy JHF, Bullying, Harassment, or Intimidation.

Revised Policies and Regulations

ACG-RB Accommodations and Services to Students Qualifying Under Section 504 of the Rehabilitation Act of 1973

On October 19, 2009, the superintendent made revisions to Regulation ACG-RBAccommodations and Services to Students Qualifying Under Section 504 of the Rehabilitation Act of 1973. This regulation was revised to reflect the Americans with Disabilities Act of 2008 (ADAAA).


BOA Legal Services

On October 26, 2009, the Board recommended non-substantive changes to Policy BOALegal Services, to clarify that the Board will receive evaluative reports on legal services on a cycle aligned with contract reconsideration. Language was added to clarify the primary functions of counsel retained by the Board.


BOA-RA Management of Legal Services

On February 24, 2010, the superintendent made revisions to Regulation BOA-RAManagement of Legal Services. This regulation was revised to reflect recent changes to the associated Policy BOA, Legal Services.


DDA-RA Seeking and Securing Federal, State, and Private Grants

On April 21, 2010, the superintendent made revisions to Regulation DDA-RASeeking and Securing Federal, State, and Private Grants. This regulation was revised raise the dollar amount for small grants from $10,000 to $20,000 for the purpose of encouraging grant seekers and simplifying procedures in response to grantors requests. Other revisions include updates to reflect current practice and editorial changes to eliminate redundancy.


ECJ-RA Animals on School Grounds

On March 16, 2010, the superintendent made revisions to Regulation ECJ-RAAnimals on School Grounds. This regulation was revised to clarify local municipal codes with respect to animals on school grounds and to give further guidance to school administrators, in response to community concerns.


ECK Use of Smith Center for Non-MCPS Groups

On February 17, 2010, the Board adopted the updated Policy ECKUse of Smith Center for Non-MCPS Groups. The policy authorizes the superintendent of schools to permit the use of the Smith Center by non-profit groups.


EEA-RA Student Transportation

On April 21, 2010, the superintendent made revisions to Regulation EEA-RAStudent Transportation. This regulation was revised to align with Board updates to Policy EEA, Student Transportation.


EEB-RA Operation and Care of MCPS Buses

On April 21, 2010, the superintendent made revisions to Regulation EEB-RAOperation and Care of MCPS Buses. This regulation was revised to clarify current procedures.


EID Defined Contribution Retirement Savings Plans

On April 15, 2010, the Board adopted the updated Policy EIDDefined Contribution Retirement Savings Plans. This policy provides defined contribution retirement savings programs for all employees. The policy update continues the Montgomery county Board of Education's commitment to maintain a plan of retirement/pension benefits which is adequately funded and will provide income to employees during their retirement years.


GFC Reassignment of Employees Within Two Years of Normal Retirement Eligibility

On February 17, 2010, the Board adopted the updated Policy GFCReassignment of Employees Within Two Years of Normal Retirement Eligibility. The policy which was renamed, sets forth the guidelines for maintaining salary and retirement benefit levels for personnel who are transferred or assigned to positions with a lower salary classification, especially within two years or retirement.


GFC-RA Reassignment of Employees Within Two Years of Normal Retirement Eligibility

On March 16, 2010, the superintendent made revisions to Regulation GFC-RAReassignment of Employees Within Two Years of Normal Retirement Eligibility. The regulation was updated to reflect current human resources policy, the current organization, and to align with updated Policy GFC, Reassignment of Employees Within Two Years of Normal Retirement Eligibility.


GIG Funding Retirement/Pension System

On October 26, 2009, the Board adopted the revision of Policy GIGFunding Retirement/Pension System. The policy sets forth the priorities of the Montgomery County Public Schools Employees Retirement and Pension System. The policy revision continues the Board of Education's commitment to maintain a plan of retirement/benefits which is adequately funded and will provide income to employees during their retirement years.


GJA-RA Professional Growth Systems (PGSs) for MCPS Employees

On October 19, 2009, the superintendent made revisions to Regulation GJA-RAProfessional Growth Systems (PGSs) for MCPS Employees. This regulation was revised to include procedures for implementing the Professional Growth Systems for all Montgomery County Public Schools employees.


GMG-RA Tuition Reimbursement

On September 29, 2009, the superintendent made revisions to Regulation GMG-RATuition Reimbursement. This regulation was revised to make practices consistent across employee associations to the degree that a single regulation brings greater clarity and reflects current practice.


IKA-RA Grading and Reporting

On May 12, 2010, the superintendent made revisions to Regulation IKA-RAGrading and Reporting. This regulation was revised to reflect the recommendations of the Loss of Credit project team.


IKC-RA Grade Point Averages (GPA) and Weighted Grade Point Averages (WGPA)

On May 12, 2010, the superintendent made revisions to Regulation IKC-RAGrade Point Averages (GPA) and Weighted Grade Point Averages (WGPA). This regulation was revised to reflect the recommendations of the Loss of Credit project team.


IOE-RB Home and Hospital Teaching

On November 6, 2009, the superintendent made revisions to Regulation IOE-RBHome and Hospital Teaching. This regulation was revised to clarify procedures to report attendance for students receiving services through Home and Hospital Teaching.


IOH-RA Mental Health Referrals

On August 13, 2009, the superintendent made revisions to Regulation IOH-RAMental Health Referrals. This regulation was revised to replace the Collaborative Action Process (CAP) with Collaborative Problem Solving (CPS).


IOI-RA Placement Procedures for Alternative Programs

On August 13, 2009, the superintendent made revisions to Regulation IOI-RAPlacement Procedures for Alternative Programs. This regulation was updated to reflect current practice and the reorganization of the Department of Student Services.


IQD-RA Academic Eligibility for High School Students Who Participate in Extracurricular Activities

On May 12, 2010, the superintendent made revisions to Regulation IQD-RAAcademic Eligibility for High School Students Who Participate in Extracurricular Activities. This regulation was revised to reflect the recommendations of the Loss of Credit project team.


JEA-RA Student Attendance

On May 12, 2010, the superintendent made revisions to Regulation JEA-RAStudent Attendance. This regulation was revised to reflect the recommendations of the Loss of Credit project team.


JEB-RA Placement, Promotion, Acceleration, and Retention of Students

On March 23, 2010, the superintendent made revisions to Regulation JEB-RAPlacement, Promotion, Acceleration, and Retention of Students. This regulation was revised to reflect current practice and recently revised policies related to the placement of students in Pre-kindergarten through Grade 12.


JEE-RA Transfer of Students

On January 4, 2010, the superintendent made revisions to Regulation JEE-RATransfer of Students. This regulation was revised to update offices and reflect current practice.


JEG-RA Home Schooling

On August 13, 2009, the superintendent made revisions to Regulation JEG-RAHome Schooling. This regulation was updated to reflect current practice and the reorganization of the Department of Student Services.


JPA-RB Screening Programs: Lead, Hearing, and Vision

On August 13, 2009, the superintendent made revisions to Regulation JPA-RBScreening Programs: Lead, Hearing, and Vision. This regulation was updated at the request of the School Health Services Unit, Department of Health and Human Services, to indicate the current grade levels and conditions under which hearing and vision screenings occur.

Rescinded Policies and Regulations

CFA-RA Site-based Participatory Management

On August 10, 2009, the superintendent rescinded Regulation CFA-RA, Site-based Participatory Management. As a result of the rescission of Policy CFA, Site-based Participatory Management, Regulation CFA-RA is no longer a viable regulation.


ECD Use of Playgrounds

On October 26, 2009, the Board rescinded Policy ECD, Use of Playgrounds. The use of playgrounds is not a matter central to the governance of the school system thus warranting a policy. Two existing Montgomery County Public Schools regulations currently provide guidance to schools on the use of playgrounds by outside groups and trespassing on school grounds.


EGA-RA Publications and Graphic Arts Services

On July 23, 2009, the superintendent rescinded Regulation EGA-RA, Publications and Graphic Arts Services. The regulation is not suited for electronic documents and graphics and does not take into account advances in the communication process for editing manuscripts and documents. The Office of Communications and Family Outreach maintains a process to ensure that publications are reviewed to meet both systemwide and content expert requirements.


GBB Department of Employee Assistance Services

On April 15, 2010, the Board rescinded Policy GBB, Department of Employee Assistance Services. The policy was rescinded because the overarching human resources policy, Policy GAAPositive Work Environment in a Self-renewing Organization specifically directs the system to support employee well-being through the provision of an employee assistance program. Procedures to address employee well-being are included in Regulation GBB-RAEmployee Assistance Program.


GEA-RB Selection of Teacher Specialists, Resource Teachers, and Resource Counselors

On September 21, 2009, the superintendent rescinded Regulation GEA-RB, Selection of Teacher Specialists, Resource Teachers, and Resource Counselors. The procedures described in the regulation no longer reflect current practice.


GFA Establishment of Permanent and Conditional Positions

On July 14, 2009, the Board rescinded Policy GFA, Establishment of Permanent and Conditional Positions. This policy was rescinded because it has been subsumed by Policy GAAPositive Work Environment in a Self-renewing Organization.


GJB-RA Evaluation of Professional Personnel

On December 8, 2009, the superintendent rescinded Regulation GJB-RA, Evaluation of Professional Personnel. The procedures described in this regulation no longer reflect current practice and the evaluation procedures are addressed in the newly revised Regulation GJA-RAProfessional Growth Systems for MCPS Employees.


GKB-RB Grievance—Supporting Services Personnel

On March 9, 2010, the superintendent rescinded Regulation GKB-RB, Grievance—Supporting Services Personnel. The content is included in the Negotiated Agreement between SEIU Local 500 and the Montgomery County Board of Education.


GMB Internship Program in School Administration

On July 14, 2009, the Board rescinded Policy GMB, Internship Program in School Administration. This policy was rescinded because it is regulatory in nature and has been subsumed by Policy GAAPositive Work Environment in a Self-renewing Organization.


GMF-RA Staff Development Programs for Supporting Services Employees

On September 28, 2009, the superintendent rescinded Regulation GMF-RA, Staff Development Programs for Supporting Services Employees. This regulation has been combined with Regulation GMG-RATuition Reimbursement for Teachers and subsequently, rescinded.


GMH-RA Graduate Course Tuition Reimbursement for Eligible MCAASP Unit Members

On September 28, 2009, the superintendent rescinded Regulation GMH-RA, Graduate Course Tuition Reimbursement for Eligible MCAASP Unit Members. This regulation has been combined with Regulation GMG-RATuition Reimbursement for Teachers and subsequently, rescinded.
